Jacqueline G. Veit Warns of Legal Duty to Preserve Documents Pre-Litigation

Jacqueline G. Veit, Partner in GEAB&P’s Litigation department, published a Client Alert entitled, “Navigating the Pre-Litigation Duty to Preserve Emails and Other Records.” This Client Alert warns of the legal duty to preserve emails and other records even before litigation commences, explains the risk of sanctions for even negligent (as opposed to deliberate) failure to do so, and provides actionable advice for clients when they face the potential for litigation giving rise to this duty.

Veit concludes in her alert, “Companies should work with counsel to determine the scope of the ‘legal hold’ and how to implement it in a cost-efficient manner, while maintaining compliance with preservation obligations.”
