GEAB&P Obtains Dismissal of All Counterclaims in Federal Court Action

GEAB&P successfully moved for dismissal of all counterclaims asserted against Frank Brunckhorst Co., LLC and Boar’s Head Provisions Co., Inc. by a former distributor of Boar’s Head Brand products, in a case pending in the United States District Court for the Eastern District of Virginia. In a 23-page Order and Opinion dated January 29, 2008, United States District Judge Jerome B. Friedman dismissed all nine causes of action asserted by the former distributor in its 174-paragraph counterclaim, including claims for breach of contract, tortious interference with contract, business conspiracy and unjust enrichment. Brunckhorst’s claims against the former distributor for failing to pay for goods sold and delivered and for infringement and abuse of the Boar’s Head Brand trademarks remain in the case.
