Marc D. Rosenberg

Marc Rosenberg is a partner in the bankruptcy, reorganization and creditors’ rights group at Golenbock Eiseman Assor Bell & Peskoe LLP. He has practiced in the restructuring field on behalf of a diverse client base for more than 20 years. He regularly represents financially distressed companies, and purchasers of and investors in such companies. He also represents foreign liquidators, indenture trustees, secured and unsecured creditors, creditors’ committees, lenders, landlords and tenants in bankruptcy and distressed situations. Marc has a wide breadth of industry experience, including retail and apparel, energy, healthcare, manufacturing, media and real estate, among others.

Marc’s experience includes advising:

  • Secured lenders in Ahern Rentals, Foamex and SemGroup bankruptcy cases, including structuring debtor in possession and exit financing arrangements.
  • Indenture trustees in Horsehead Holding and New Gulf Resources chapter 11 cases.
  • Jones Apparel in its acquisition of Kasper pursuant to confirmed plan of reorganization and Haier Medical in its proposed acquisition of certain assets from Taylor-Wharton Cryogenics pursuant to section 363 sale.
  • Foreign liquidators in Sovereign Assets Ltd. chapter 15 (cross border) case.
  • Landlords and lease purchasers in retail bankruptcies, including Sports Authority, RadioShack and A&P cases.
  • I/P Licensors on issues at the intersection of bankruptcy and intellectual property law.
  • Debtor in Integrated Health and Rotech Medical chapter 11 cases.
