Elizabeth Conway is a litigator whose practice is particularly diverse, representing individuals and businesses, foreign and domestic, in all phases of dispute resolution – from investigation through trial and appeal.  A strategic thinker, Beth focuses on a clear understanding of her clients’ ultimate goals and then works backwards to determine best how to achieve them.  Her clients appreciate her thoughtful, calculated and realistic approach to disputes.  Beth is a fierce advocate for her clients when in court; but she also aggressively manages the litigation process to avoid unnecessary and unproductive procedures when possible.

Representative engagements:

  • Regularly advises restaurant and hospitality clients on various day-to-day issues involving real estate, compliance with state and federal regulatory matters, discrimination claims, employment issues and start-up and joint venture disputes.
  • Represented the National Restaurant Association (“NRA”) in a lawsuit to enjoin New York City’s Department of Health and Mental Hygiene from enforcing a regulation the NRA asserted was onerous and unenforceable. Obtained emergency injunctive relief from the Appellate Division, First Department, temporarily staying enforcement of the regulation.
  • Represented the estate of famous illustrator and author Maurice Sendak, in a dispute concerning the distribution of certain valuable assets in Connecticut Probate Court, which resulted in a favorable outcome at trial.
  • Represented foreign liquidators for recognition under Chapter 15 of the U.S. Bankruptcy Code, enforcing claims and discovery in U.S., which involved successfully defeating opposition to recognition at an evidentiary hearing.
  • Successfully represented a selling agent and broker in breach of contract action involving $14+ million in damages against defendant pharmaceutical company for failure to pay investment fees.
  • Successfully defended state and federal discrimination claims in the New York State Division of Human Rights.
  • While with a prior firm, obtained favorable settlement following three weeks of trial in the Southern District of New York on behalf of a manufacturing company seeking approximately $750 million in damages from the defendant corporation for breaches of indemnification obligations arising from a $4 billion acquisition agreement. Served as trial counsel and second chair for component of case concerning, among other issues, Clean Air Act claims involving over $500 million in potential damages.  Coordinated discovery including review of over 30 million documents and production of over 20 million pages.
