Mr. Furth is an experienced bankruptcy lawyer who has successfully represented institutional lenders including indenture trustees, chapter 11 trustees, chapter 11 debtors, and statutory committees in the work-out, bankruptcy or restructuring of billions of dollars of debt across a wide spectrum of industries including real estate, mortgage lending, hotels, health care, steel, publishing, textiles, paper, retail, automobiles, manufacturing, toys, distribution, oil and gas and fast food. Mr. Furth was a pioneer in the negotiation and implementation of prepackaged chapter 11 cases, having been involved in over 20 such transactions. Mr. Furth has represented the acquirers of a variety of significant assets from chapter 11 debtors, including the successful purchaser of a major New York City office tower, a well-known hotel franchise, airplane equipment and many retail locations. Mr. Furth is av rated by Martindale-Hubble.

  • Represented Indenture Trustee in fraudulent transfer litigation in Lyondell Chemical Company.
  • Represented Certificate Holder in litigation with other Certificate holders of Extended Stay, Inc.
  • Represented Indenture Trustee in Charter Communications, Inc.
  • Represented Indenture Trustee in Sem Crude, L.P.
  • Represented the chapter 11 trustee for Copperfield Investments, LLC, the owner of approximately 500 non-performing residential mortgages.
  • Represented the stalking bidder and partially owned subsidiary of chapter 11 debtor Refco, Inc. to repurchase Refco's minority interest in the subsidiary.
  • Represented chapter 11 debtor Whitehead Mann, Inc., the United States subsidiary of one of world's largest executive search firms.
  • Represented the indenture trustee in a number of cases, including Dan River, Inc., a domestic textile manufacturer, General Media, Inc., a magazine publisher, and Wilcox & Gibbs, a manufacturer of sewing machines.
  • Represented largest bondholder of Weirton Steel.
  • Represented chapter 11 debtor Farmland Industries as financial advisor to the debtor responsible for sale of major business unit.
  • Represented the successful plan proponent and partially owned subsidiary of chapter 11 debtor Marvel Entertainment, Inc. in epic battle for control of Marvel Entertainment.
  • Represented the chapter 11 debtor in 401 East 89th Street Owners, Inc., the largest New York City cooperative corporation ever to successfully emerge from chapter 11.
  • Represented secured lender in many hotly contested real estate chapter 11 cases representing billions of dollars of secured debt.
  • Represented bondholder's committee and successful plan proponent in chapter 11 case for Olympia & York, one of New York's largest real estate developers.
  • Represented limited partners committee in chapter 11 case of Alert Centre, Inc., in which limited partners emerged as holders of equity of reorganized rolled-up company.
  • Represented the creditor's committee as special litigation counsel in the Ames Department Stores chapter 11 case.
  • Represented the debtor in the chapter 11 case for Apparel Affiliates, Inc., a 107-unit retail chain that successfully emerged from chapter 11.
  • Represented the senior secured creditor in the chapter 11 case for Coleco, a leading toy manufacturer.
  • Represented the debtor in the chapter 11 case of Texaco, Inc.
